壹、課程概要
資訊科技的發展已然歷經數十年，討論「資訊社會」的國內外相關文獻，也幾乎可以用汗牛充棟這樣的說法來形容，然而，網際網路科技的進一步興起，無疑是將人類賴以溝通的科技引領到一個全然不同的嶄新境界。人類社會在網際網路科技的輔助和衝擊下，如何才能尋找出最為適當的發展途徑，儼然成為永續社會的研究議題之一。自從網路活動普及以來，網路社會應該受到何種程度與型態的規範，一直是廣受討論的議題。對於網路社會的規範與秩序，多數人是抱持著源自事實世界的既成法律觀念進行理解與批評。在此一理解架構下，我們通常習於認定現實世界的現存法律制度應該直接適用於網路社會，而來自現實世界的國家公權力往往急於介入網路社會的運作，甚至進行直接管制，失於短視，導致不少荒謬失衡的現象產生。
本課程的主要目的，乃是希望提供一個較為衡平而不流於高度管制心態的架構，以網路社會目前所面對的規範問題為例，針對資訊科技和法律之間的關係，進行探討。本課程將討論在目前的網路社會規範趨勢下，來自現實世界的法律制度，和發軔於網路社會的社會規範與資訊科技，目前互動關係的來龍去脈，以及未來發展全貌究竟將朝何等方向發展。本課程除了帶領參與者理解資訊科技法律的具體問題，包括網路社群規範、智慧財產權保護、資訊隱私、內容規範等議題外，也希望能夠探討網際網路全球性公共資源分配所引發的諸多議題、網際網路所涉及的市場規範難題，進而引導出網際網路科技社群是否應該以及如何受到合乎民主程序和權責相符原則的監督和規範此一根本問題，希望藉由上述各個領域的探索，為課程參與者建立起思考資訊社會最適規範架構的基礎。

壹、課程概要
本課程旨在探討法律與社會變遷的基本理論和相關議題。在現代社會的日常生活中，法律可以說是尋常而必要的一環，然而，做為重要社會體制之一的法律制度，究竟如何運作，究竟如何發揮功能，和其他社會體制之間的關係如何，法律和社會變遷之間的互動和辯証關係又是如何，都將是本課程的探討重點。
基於以上課程目的，本課程首先將闡明的是法律和社會變遷此一研究領域的意義和重要性；其次，我們將探討社會規範和法律規範兩者之間的互補和互動關係，並且以實例說明社會規範形成和運作的面貌。接著，本課程將分析法律制度如何扮演推動社會變遷的角色，並且進而分析法院與社會變遷的關係。最後，本課程將自民主憲政和政治轉型期正義的觀點，探討民主憲政和社會變遷的相關議題，以及分析政治轉型期所面臨的諸多難題及其可能解決途徑。

課程內容摘要：
科技發展為社會建構的過程，尤其在全球化時代其發展影響深遠，深具研究的意義，可分化為科技與政治、科學論述與科技決策、科技與權力、技術官僚統治、公民參與科技評估等研究領域。尤其是當代高科技（諸如核能、基因、資訊科技）對社會衝擊與影響甚鉅，並挑動了傳統社會學研究領域的界限。
本課程則溯本清源首先從科技與政治的關係，討論科技決策的總體面向；其次站在台灣做為後進科技學習國，探討我國所面臨的科技決策、國家經驗與社會批判經驗問題；第三個主題集中於研究科學專業所提供的科技論述、科技真理發展觀對國家科技決策的重大影響；第四部份集中於技術官僚問題，探討科技專家與技術官僚的網絡影響、技術官僚本著科技專業理性對科技決策的支配、其關係間所形成介於國家、技術官僚、科學社群間的統合主義問題；最後，第五部分分析公民參與科技評估的民主意義、程序正義與在各國的實質經驗。
這門課藉研究所同學小型的分組經驗研究，讓學生發掘、體會理論與生活經驗的銜接點，進而激發與建構其科技社會學的想像。修課學生除研讀指定文獻外，透過小型分組的實際討論與報告，來簡證或深化相關概念。

本課程的主要目的，乃是希望提供一個較為衡平而不流於高度管制心態的架構，以網路社會目前所面對的規範問題為例，針對資訊科技和法律之間的關係，進行探討。本課程將討論在目前的網路社會規範趨勢下，來自現實世界的法律制度，和發軔於網路社會的社會規範與資訊科技，目前互動關係的來龍去脈，以及未來發展全貌究竟將朝何等方向發展。本課程除了帶領參與者理解資訊科技法律的具體問題，包括網路社群規範、智慧財產權保護、資訊隱私、內容規範等議題外，也希望能夠探討網際網路全球性公共資源分配所引發的諸多議題、網際網路所涉及的市場規範難題，進而引導出網際網路科技社群是否應該以及如何受到合乎民主程序和權責相符原則的監督和規範此一根本問題，希望藉由上述各個領域的探索，為課程參與者建立起思考資訊社會最適規範架構的基礎。

壹、課程概要
本課程旨在探討法律與社會變遷的基本理論和相關議題。在現代社會的日常生活中，法律可以說是尋常而必要的一環，然而，做為重要社會體制之一的法律制度，究竟如何運作，究竟如何發揮功能，和其他社會體制之間的關係如何，法律和社會變遷之間的互動和辯証關係又是如何，都將是本課程的探討重點。
基於以上課程目的，本課程首先將闡明的是法律和社會變遷此一研究領域的意義和重要性；其次，我們將探討社會規範和法律規範兩者之間的互補和互動關係，並且以實例說明社會規範形成和運作的面貌。接著，本課程將分析法律制度如何扮演推動社會變遷的角色，並且進而分析法院與社會變遷的關係。最後，本課程將自民主憲政和政治轉型期正義的觀點，探討民主憲政和社會變遷的相關議題，以及分析政治轉型期所面臨的諸多難題及其可能解決途徑。

課程內容摘要：
科技發展為社會建構的過程，尤其在全球化時代其發展影響深遠，深具研究的意義，可分化為科技與政治、科學論述與科技決策、科技與權力、技術官僚統治、公民參與科技評估等研究領域。尤其是當代高科技（諸如核能、基因、資訊科技）對社會衝擊與影響甚鉅，並挑動了傳統社會學研究領域的界限。
本課程則溯本清源首先從科技與政治的關係，討論科技決策的總體面向；其次站在台灣做為後進科技學習國，探討我國所面臨的科技決策、國家經驗與社會批判經驗問題；第三個主題集中於研究科學專業所提供的科技論述、科技真理發展觀對國家科技決策的重大影響；第四部份集中於技術官僚問題，探討科技專家與技術官僚的網絡影響、技術官僚本著科技專業理性對科技決策的支配、其關係間所形成介於國家、技術官僚、科學社群間的統合主義問題；最後，第五部分分析公民參與科技評估的民主意義、程序正義與在各國的實質經驗。
這門課藉研究所同學小型的分組經驗研究，讓學生發掘、體會理論與生活經驗的銜接點，進而激發與建構其科技社會學的想像。修課學生除研讀指定文獻外，透過小型分組的實際討論與報告，來簡證或深化相關概念。
